This proposal does not include for any ground works, foundations, internal finishes, electric wiring, light installations, floor finishes, plumbing, buildings consent and changes to agreed prepared openings. This quotation is presumed on access being provided by others if required, we are able to provide our own access at an additional cost further to a site survey.

As we can accept your order and make a legally enforceable agreement without further reference to you, you must read these terms and conditions to make sure that they contain all that you want and nothing that you are not happy with
1. These Terms and Conditions will apply to the purchase of the goods by you (the Customer or you) We are Guernsey Glazing Ltd a company registered in Guernsey under number 69459.
2. These are the Terms on which we sell all Goods to you. By ordering any of the Goods, you agree to be bound by these Terms and Conditions.
3. Consumer means an individual acting for purposes which are wholly or mainly outside his or her trade, business, craft or profession;
4. Contract means the legally-binding agreement between you and us for the sale and purchase of the Goods;
5. Delivery Location means the Supplier's premises or other location where the Goods are to be supplied, as set out in the Order;
6. Goods means any goods that we supply to you, of the number and description as set out in the Order;
7. Order means the Customer's order for the Goods from the Supplier as set out in the Customer's order or in the Customer's written acceptance of the Supplier's quotation.
8. The description of the Goods is as set out in our contract paperwork as provided, the contract and T & Cs run parallel together
9. In the case of Goods made to your special requirements, it is your responsibility to ensure that any information you provide is accurate.
10. All tenders/quotations issued by Guernsey Glazing Ltd shall be valid for 3 Months (subject to review)
11. We normally require a minimum of 5 working days from receipt of official acceptance of our estimate to process the order and allocate relevant personnel. The estimated timescale for delivery is stated as above and any delivery dates quoted or programmes issued are always subject to supplier delivery dates.
12. We have included only for work described and scheduled within this estimate. Any other works which may be found necessary after the commencement of the work and which could not reasonably have been identified at the time of tender will be subject to an additional charge based upon current rates. Any works not specifically referenced herein shall be deemed as being specifically excluded and will not, therefore, form part of our scope of works.
13. All tenders/estimates are provided in good faith but Guernsey Glazing Ltd reserves the right to correct errors and omissions up until the payment of the deposit invoice.
14. Guernsey Glazing Ltd reserves the right to alter our tender/quotation should the actual size of the project be different from the information provided by the client or the client’s representative.
15. Prices for work included in any tender/quotation are based upon uninterrupted access to the customer’s premises until completion of the work.
16. In the event that the second payment does not become due within 6 months of the initial payment, Guernsey Glazing Ltd reserves the right to revise the original quotation, so as to take into account any rises in Guernsey Glazing Ltd pricing policy and/or any rises in costs of goods or services charged to Guernsey Glazing Ltd.
17. The contract will be between Guernsey Glazing Ltd and the property owner/leaseholder, who will be assumed to be the end client unless otherwise advised.
18. Guernsey Glazing Ltd will not act as a sub-contractor, working for and being paid by a main contractor unless agreed in writing.
TIME
19. Guernsey Glazing Ltd will use its best endeavours to deliver the goods and to complete all work at the rate and within the time estimated, but Guernsey Glazing Ltd shall not be liable for any loss or damage whatsoever suffered by the customer as a result of any failure by, Guernsey Glazing Ltd for whatever reason, to deliver or to complete the works at the rate or within the time so specified. Unless specifically agreed in writing by a Director of Guernsey Glazing Ltd, time shall not be of the essence of the contract.
20. Given the fragile nature of the materials, the extended lead time for glass and the tight programmes we work to, we do not accept any LAD clauses. In the event that we specifically confirm our acceptance of such, and in any event and irrespective of the damages levied against us, our maximum exposure and or liability would not exceed a total of 5% of our original contract sum. Any programme dates we may confirm or agree to are always subject to supplier delivery dates. No monies may be withheld from us until documentary evidence is provided which proves that the contractor/client has had such monies withheld from their account.
21. The property of the goods, whether fixed or unfixed, shall not pass to the customer until the receipt of the Final payment and all sums owing in respect of the goods, at that time and/or the project as a whole (whether under this or any other contract) shall have been paid in full: such goods are referred to as the “retained goods”. Until payment of all such sums the customer shall hold the retained goods in a fiduciary capacity for and on behalf of Guernsey Glazing Ltd.
22. Until such time as the property in the retained goods passes to the customer, Guernsey Glazing Ltd shall be entitled at any time to require the customer to deliver up the retained goods and shall be deemed irrevocably to authorise Guernsey Glazing Ltd to enter upon any of the customer’s premises, with or without vehicles, for the purpose of removing the retained goods.
23. The repossession of the retained goods by Guernsey Glazing Ltd in accordance with this condition shall be without prejudice to all or any of Guernsey Glazing Ltd other rights against the customer under this Contract.
24. The customer shall not be entitled to pledge in any way charge by way of security for any indebtedness the retained goods or any part of them which remains the property of Guernsey Glazing Ltd, but if the customer does so all monies owing by the customer to Guernsey Glazing Ltd shall (without prejudice to any other right or remedy of (Guernsey Glazing Ltd) forthwith become due and payable.
25. Guernsey Glazing Ltd reserves the right to substitute materials and specifications, conditional on the specification or materials not being of a lower standard.
26. Glass Tolerances As with all processed laminated glass or double-glazed units, unless otherwise specified, all glass supplied to a customer, with working drawings, will have a standard tolerance of +/- 2mm. Any glass requiring C&C work, machining, shaping, laminating or DGU processing must be clearly documented by the customer as to which way round coated glass is to be assembled or laminated and the exact location of holes and polishing details. Bubbles in laminated glass will be deemed to be acceptable provided that they do not exceed 0.5-1.00mm in diameter and spaced more than 750mm in any direction.
27. Glass can be susceptible to spontaneous failure for reasons such as nickel sulphide inclusions and thermal fracture and therefore once our glass has been incorporated into the main works, in such circumstances where a unit may fail due to such occurrences or from any other undeterminable reasons, or resultant from damage by others known or unknown, then any replacement items will be charged at an extra over cost and will be priced as a variation to our works. Where glass is specified as toughened, we recommend that you consider heat soak treatments to the glass to reduce the possibility of such failures for which we would confirm our extra over costs.
28. Whilst every effort is made to accurately specify the correct glass thicknesses, it is not possible to fully engineer all tender enquires received. On that basis any changes to the stated glass specifications as contained herein, which are necessitated by the engineering or design process, such changes will be at extra over cost and will be quoted for as a variation.
29. In any instance where EVA Lamination film is to be used, a join line may be visible on any panels over 2100mm wide. A sample of this can be viewed at our offices, or a sample can be arranged to be sent, for approval, if a contract is agreed.
30. Guernsey Glazing Ltd installs all glazing units to current British Standards, incorporating a low ‘e’ coated glass. Units conform to Building Regulation Approved Document Part L1/L2 accordingly. Specifically, requirements for glazed units in metal frames to have a U-value less than 2.2W/m2K. The actual U-value varies marginally with size, orientation and frame condition. As a minimum standard Guernsey Glazing Ltd typically use Pilkington ‘K’ glass with a 16mm spacer bar providing U-value of 1.6 W/m2K. Lower U-values can be achieved if specifically requested by the client. Guernsey Glazing Ltd does not accept responsibility for sizing allowable glazed areas or providing thermal calculations for planning or Building Control purposes. These calculations must always take into account the entirety of the building envelope and the building’s function. These calculations are therefore the responsibility of the client and his representatives.
31. All goods delivered to the customer whether fixed or unfixed shall be at the sole risk of the customer and in the event of the goods or any part thereof being lost, damaged, destroyed or stolen, howsoever occurring before payment for them in full has been made to Guernsey Glazing Ltd, the customer shall nevertheless pay The Guernsey Glazing Ltd the full value of any such goods and the full value of any of the work damaged, destroyed or lost together with any additional costs incurred by Guernsey Glazing Ltd in replacing any such goods and in reinstating or restoring any such work provided, however, that the customer shall not be responsible for any damage or loss sustained arising predominantly from the negligence of Guernsey Glazing Ltd, its servants or Agents.
32. Delivery of the goods shall be made, and risk of damage to or loss of the goods shall pass to the customer when Guernsey Glazing Ltd delivers the goods to that customer or to a place designated by the customer.
33. If for any reason the customer is unable to accept delivery of the goods or any part of the goods at the time when it has been agreed that the goods or any part of the goods shall be delivered, the customer shall be liable for all expenses (+10% handling fee) incurred by Guernsey Glazing Ltd due to said inability to accept delivery. This shall include, but not at the exclusion of any other costs, storage charges and charges for labour that cannot otherwise be deployed.
34. The customer will allow Guernsey Glazing Ltd, its servants and Agents due access so as to be able to commence and complete the installation of the goods or any part of the goods. If for any reason the customer is unable to permit Guernsey Glazing Ltd to commence and/or continue and/or complete the installation of the goods or any part of the goods the customer shall be liable for all additional expenses incurred by Guernsey
Glazing Ltd.
35. The installation by Guernsey Glazing Ltd of any glass, fittings or other materials in no way endorses, verifies or gives approval of any structure, existing or new, and clients must satisfy themselves of the suitability of any said structures.
36. Should upon full and final fitting, lock locators are to be placed into any finished flooring/ceiling, any drilling or works to any finished flooring/ceiling will have to be carried out by another. Guernsey Glazing Ltd will not carry out works to any finished surfaces nor be held responsible or accountable to any damage that may occur.
37. Unless stated above, the works are not to be re-measured at completion. Variations will be assessed and charged, where possible.
38. Variations and or extra over works will only be undertaken once we are in receipt of a formal written instruction unconditionally accepting the works as quoted by us. No such works will be undertaken unless the additional time and costs confirmed within our variation quotation are fully and unconditionally accepted and any instruction received from you by us will be deemed as such acceptance. We apply the following mark-ups to our costs; 40% overhead recovery plus 25% profit.
39. Unless otherwise stated above, the contract works will be undertaken to openings and substrates fully prepared, lined and levelled by other trades. All making good to works disturbed are also to be made good by other trades, at no cost to ourselves.
40. We have allowed for the removal of labels and cleaning down of glass, only after our works have reached completion of installation. This is a general clean and not a polished finish. All other cleaning, including the final builders clean at the end of the project, is excluded and to be by others.
41. Guernsey Glazing Ltd shall not be liable to the customer if it is unable to carry out any provision of the contract for any reason beyond its control including (but without limitation) Act of God, legislation, war, civil commotion, explosion, abnormal weather conditions, fire, floods, strikes, lock-out or other action by employees, delay by suppliers.
42. Guernsey Glazing Ltd shall notify the customer as soon as reasonably practical after the circumstances preventing performance arise. During the continuance of such a contingency Guernsey Glazing Ltd may, in its absolute discretion, withhold liability to the customer for any loss or damage whatsoever suffered directly or indirectly by reason of such withholding, reduction or suspension.
43. While Guernsey Glazing Ltd will take reasonable care to ensure that working plans, diagrams and drawings provided to the customer are adequate to facilitate the erection or installation of the goods in a proper and workmanlike manner, it shall, in relation to any part of the structure or work not erected or undertaken by Guernsey Glazing Ltd, be the sole responsibility of the customer to ensure all working plans, diagrams and drawings meet the customer’s requirements in every respect.
44. Unless otherwise stated above, no allowance has been made for any design or preparation of working drawings. When we are required to produce working drawings or details, we require a minimum of 20 working days from receipt of fully dimensioned construction drawings in CAD format to produce our initial drawings for approval. This period may be extended and will always be subject to capacity at the time of placing your order with us. We require the formal approval of our design drawings prior to commencing manufacture.
45. When drawings, plans and calculations are provided by others, Guernsey Glazing Ltd shall be in no way liable for any loss or damage due to errors and/or omissions within those drawings, plans and calculations.
46. If drawings submitted to us for pricing purposes are provided with no dimensions, our estimators will use a relevant scale to measure and thus price. It is then down to the client to appropriately check and clarify that our dimensions are correct.
47. The installation and completion of work by Guernsey Glazing Ltd shall in no way be taken as an endorsement and/or approval of design and calculation of others.
48. The customer shall be liable for ensuring that Guernsey Glazing Ltd is in possession of current drawings and plans and Guernsey Glazing Ltd shall not be liable for any loss or damage caused due to not being in possession of the current drawings and plans.
49. It shall be the sole responsibility of the customer to ensure works not carried out by Guernsey Glazing Ltd are in accordance with the drawings and plans, whosoever should provide said plans and drawings. In the event of said work being at variance to the plans and drawings, Guernsey Glazing Ltd shall not be liable for any loss or damage however caused.
50. Guernsey Glazing Ltd will prepare the final Guernsey Glazing Ltd design and glass cutting list based on the results of our survey and will assume that any variance between what is shown on any plans or drawings, whoever should have prepared said drawings or plans, and what has actually been constructed, has been approved by the client.
51. In the event of work by others being in variance with the drawings and plans, the customer shall be liable for all costs and expenses incurred by Guernsey Glazing Ltd due to said variance.
52. Failure to provide full completion of all building works ready for site survey and secondary survey’s are required will result in the cost of original survey being paid by the client and will be in addition to contract sum.
53. Guernsey Glazing Ltd reserves the right to change materials and specifications without updating detailed drawings. Any changes must provide an equivalent or better specification.
54. In the event that the customer should employ a Project Manager, architect or builder and the customer should require Guernsey Glazing Ltd to communicate and deal with said person who is to act as Project Manager, the customer shall inform Guernsey Glazing Ltd in writing of the name and full contact details of said person.
55. The appointment of a person as described and the completion by the customer of responsibility outlined in said clause shall not discharge the customer from any responsibilities under the Contract or discharge the customer from responsibility and/or liability as laid down by these Terms and Conditions.
56. The client is not permitted, unless agreed in writing by Guernsey Glazing Ltd, to divulge any technical information, specifications or processes to any other third party.
57. Guernsey Glazing Ltd reserves the right to photograph work undertaken by the company for promotional publicity purposes and/or editorial content, periodicals, social media and website material under the terms of the agreed contract and for a further period of 12 months after project completion subject to reasonable notice of intent.
58. The photographer, private or commissioned, will keep confidential, and not disclose to any third parties or make use of information communicated to him/her in confidence for the purposes of the photography, save as may be reasonably necessary to enable the photographer to carry out his/her obligations in relation to the commission.
59. Guernsey Glazing Ltd retains copyright in our designs, standard or drawings.
60. Specific designs, drawings or other work carried out by Guernsey Glazing Ltd with reference to a specific project, scheme or concept must not be included in any documents, tenders or otherwise, which have the intention of gaining prices from others for the provision of work based on or using any system, design or drawings developed by Guernsey Glazing Ltd.
61. This estimate is based upon clear un-obstructed, safe, access to all working areas.
62. Ground conditions on site must be suitable for the safe transportation of glass and for the use of machinery as required by Guernsey Glazing Ltd. Any costs or delays incurred by Guernsey Glazing Ltd due to unsuitable site conditions will be passed on to the client.
63. Clients must provide a minimum of 2 parking spaces in close proximity to the site for the duration of the installation. Should permits be required, Guernsey Glazing Ltd can arrange for such permits and these will be charged at cost plus an administration fee.
64. All sites must have provision for hygienic washing and toilet facilities. In the event that facilities do not meet the requirements of Guernsey Glazing Ltd health and safety policy, Guernsey Glazing Ltd will arrange for the provision of suitable portable facilities at a rate of £400.00 per week, payable by the client.
65. Following installation of the glazed structure / glazing including balustrade and roof light, walk on glazed panel, at no time should any works be carried out above or adjacent to the glazed panels, any access required to surfaces above or adjacent which require direct access on the glass must be advised in writing to Guernsey Glazing Ltd prior to date of required access and a full inspection and consultation to determine the correct form of access and protection to the glass to be established. Should any damage to the glazed surfaces as above described be reported following works/ access Guernsey Glazing will not be responsible for any replacement or polishing of the glazed panels.
66. Unless otherwise stated above, you shall provide and maintain free of charge to ourselves scaffolding, safe access to works, harness points, 110v power, craneage & hoisting facilities (as Pricing notes 9/10), health safety and welfare facilities required to undertake the works – in accordance with all relevant Statutes, Regulations or Orders in force during the duration of the subcontract with particular reference to the Construction (Working Place) Regulation 1996, for the use and benefit of our operatives. You shall indemnify us against any failure of these requirements.
67. Where cranage is to be provided by Guernsey Glazing Ltd unless otherwise stipulated, we will only make an allowance for one crane date, accompanied by one backup date for the event of a non-lift scenario, due to inclement weather.
68. Unless otherwise stated above, you shall provide and maintain, free of charge to ourselves a 110v power supply to within 10M of the workforce.
WARRANTY
69. This Condition shall have effect in relation to a material defect in the structure of the goods for a period of 5/10 years from the date of delivery of the goods and in relation to workmanship in each stage of the installation of the goods for a period of 5 years from the completion of each stage of the installation. All double glazed units carry a 10-year warranty with the exception of our sliding doors that hold a 5 year warranty.
70. Guernsey Glazing Ltd warrant glass units against unit seal failure for a period of five years. Specialist units such as illuminated, reactive and internal blinds are limited to a one-year warranty. Units with mitred double glazed frameless corners are not covered by any warranty.
71. Guernsey Glazing Ltd will only warrant laminated glazing against delamination if the structural integrity is deemed to be undermined.
72. If within 5 years after delivery or completion of a stage of the installation a defect of materials shall be discovered:
(i) The customer notifies Guernsey Glazing Ltd in writing within fourteen days after discovery giving full particulars and permits Guernsey Glazing Ltd to inspect the same;
(ii) Such defect has arisen from faulty materials or workmanship carried out by Guernsey Glazing Ltd, existing but not discoverable at the time of delivery of the Goods, or completion of the work Guernsey Glazing Ltd shall at its sole option supply replacements or (as the case may be) rectify the defective work.
73. The Conditions listed below shall apply to repaired or replacement goods or work.
74. Guernsey Glazing Ltd liability under this condition applies only to defects appearing before the customer makes any modification or alteration to the goods and while the Goods are being properly used and maintained and in particular (but without limitation) Guernsey Glazing Ltd shall not be liable in the case of defects arising from:-
(i) Normal deterioration, in accordance with manufacturer’s recommendations
(ii) Repair, faulty handling or maintenance
(iii) Repair or modification to the goods or work by or on behalf of the customer
(iv) Defects in or subsidence to any structure or surface to which the goods are affixed or attached
(v) Glass damage or breakage not attributable to manufacturing/installation defect.
(vi) A replacement unit will be supplied free of charge to replace any double glazed unit which fails in service as a result of material defect within 5/10 years of delivery
75. This warranty is provided free of charge.
76. The warranty only applies to the replacement of defective unit(s). No inclusion within the warranty for access or lifting equipment to replace defective Unit(s), and or any damage to all or any surrounding areas, including but not limited to plaster work, painted surfaces, finished surfaces, flooring, all or any electrical wiring or illuminations.
77. The goods are supplied strictly on the terms that the customer has satisfied themselves of suitability for purpose. The customer acknowledges that all specification and details in catalogue, quotations, invoices and similar documents or by word of mouth and all forecasts of performances, however given, are approximate only and do not form part of the Contract.
78. Guernsey Glazing Ltd shall not be liable, whether by way of indemnity or reason of breach of contract, tort or breach of statutory duty or in any other manner for consequence or indirect loss of use (whether complete or partial) of the goods, or loss of profit or of any contract.
79. Our works are such that they are susceptible to damage by following trades. The application of adequate protection blocks light transmission and is quite often removed by following trades once we have left the site. Unless specifically agreed otherwise, no provision has been made for protection and Guernsey Glazing Ltd will not be held liable for damage to our works caused by others. Once installed the responsibility for the protection of the works will reside with the client/main contractor and Guernsey Glazing Ltd will accept no responsibility for any damage sustained howsoever caused.
80. Nothing in these conditions shall be construed as limiting or excluding the statutory rights of the customer.
81. Unless otherwise specifically and formally agreed to by us in writing, we do not allow for the deduction of any retentions. Where we have agreed to such deductions the first half release will become due upon practical completion of our works on site, with final half release no later than 12 months thereafter. Release dates will apply to any phased or sectional areas as and when they are practically completed. Retention levels where we have agreed to such will be 3% reducing to 1½ %.
82. The contract is not cancellable by the customer for whatever reason without prior written consent of a Director of Guernsey Glazing Ltd.
83. We reserve the right to charge interest on unpaid accounts of more than 14 days (from date of invoice) at the rate of 2.5% per day (compound).
84. Our estimate is based upon one continuous working phase. Any additional visits after completion of this phase will be subject to a minimum charge of £500.00 per man per visit.
85. The Warranties described in shall not be valid until all balances owed under this section have been settled.
86. VALUE ADDED TAX is excluded from this quotation and should it be found applicable it will be additional at the rate current at the date of invoice.
87. All quotations are quoted in U.K Pounds sterling.
88. Retention is not applicable as a full warranty is provided.
89. If an order is placed by a main contractor/builder/architect and the invoice is being sent directly to them for them to pay on the owner of the properties behalf, Guernsey Glazing Ltd will contact the owner of the property to make them aware that should for any reason the aforementioned cease trading/liquidate that all outstanding monies owed on any project relating to their property will become payable by the owner of the property (we shall not disclose any costs to the owner until such time that they become relevant. Guernsey Glazing Ltd shall own the title of the goods until such a time that all monies are fully paid.
90. 24 Hours following installation of the glazed unit(s), should any imperfections be found within or on the glass. Then we shall abide to the guidelines as laid down by the GGF (Glass and Glazing Federation) regulations.
91. If no notification is received within this 24 hour period, any imperfections found will only be (replaced/repaired) at the discretion of a director of Guernsey Glazing Ltd.
92. It is the client responsibility to ensure that all glass work is protected after it has been installed, Guernsey Glazing Ltd will not be held responsible to any damage cause to said glass after installation.
93. Any items found not to be correct should be reported in writing within 7 days to the office address or emailed,
94. In the event of any failure by a party because of something beyond its reasonable control:
a. the party will advise the other party as soon as reasonably practicable; and
b. the party's obligations will be suspended so far as is reasonable, provided that that party will act reasonably, and the party will not be liable for any failure which it could not reasonably avoid, but this will not affect the Customer's above rights relating to delivery.
95. Your privacy is critical to us. We respect your privacy and comply with the General Data Protection Regulation with regard to your personal information.
96. These Terms and Conditions should be read alongside, and are in addition to our policies, including our privacy policy and cookies policy which can be found on our website.
97. For the purposes of these Terms and Conditions:
a. 'Data Protection Laws' means any applicable law relating to the processing of Personal Data, including, but not limited to the Directive 95/46/EC (Data Protection Directive) or the GDPR.
b. 'GDPR' means the General Data Protection Regulation (EU) 2016/679.
c. 'Data Controller', 'Personal Data' and 'Processing' shall have the same meaning as in the GDPR.
d. In fulfilment of its obligations under the General Data Protection Regulations (EU [2016]) and the Data Protection Act 1988, Guernsey Glazing Ltd will only hold and use personal data for legitimate business reasons. In line with our policy of compliance, personal data will only be held for a specific time or as deemed legitimate by the company, after which the information will be securely destroyed from storage in every format.
98. We are a Data Controller of the Personal Data we Process in providing the Goods to you.
99. Where you supply Personal Data to us so we can provide Goods to you, and we Process that Personal Data in the course of providing the Goods to you, we will comply with our obligations imposed by the Data Protection Laws:
a. before or at the time of collecting Personal Data, we will identify the purposes for which information is being collected;
b. we will only Process Personal Data for the purposes identified;
c. we will respect your rights in relation to your Personal Data; and
d. we will implement technical and organisational measures to ensure your Personal Data is secure.

101. The Supplier does not exclude liability for: (i) any fraudulent act or omission; or (ii) for death or personal injury caused by negligence or breach of the Supplier's other legal obligations. Subject to this, the Supplier is not liable for(i) loss which was not reasonably foreseeable to both parties at the time when the Contract was made, or (ii) loss (eg loss of profit) to the Customer's business, trade, craft or profession which would not be suffered by a Consumer because the Supplier believes the Customer is not buying the Goods wholly or mainly for its business, trade, craft or profession).
102. The Contract (including any non-contractual matters) is governed by the law of Guernsey.
103. Disputes can be submitted to the jurisdiction of the courts of Guernsey.
